1 · Scope and provider

These terms and conditions apply to the use of Hermetia, offered by [provider / company name], [address] (“we”). The version valid at the time of conclusion of the contract is decisive.

2 · Subject of service

Hermetia is a digital offering for self-reflection. Personal profile content can be created from inputs such as dates of birth, optional time of birth, place of birth and voluntary contexts: soul map, system evaluations, convergence engine, daily impulses, journaling, relationship and resonance modules, profile refinement, AI-supported companion, export and a possible full profile book. Hermetia offers free entry-level models and paid models with extended scope. Paid services can include, in particular, more profile depth, longer texts, saved histories, companion dialogues, extended daily impulses, relationship evaluations, export functions or special profile book content. The specific service results from the respective tariff description at the time of the order.

3 · Not a substitute for specialist advice

Hermetia creates reflection content. The content does not constitute medical, psychological, psychotherapeutic, legal, tax, financial or other professional advice. Hermetia makes no diagnosis, promises no cure, makes no life decisions, and does not guarantee any prediction. If you are in an acute crisis, have health problems, need to clarify legal questions, want to make financial decisions or feel psychological stress, please contact qualified specialists or suitable emergency centers. Hermetia can provide language for introspection, but is not a substitute for professional support.

4 · Registration and conclusion of contract

Upon registration, a free usage contract is concluded. You complete a paid model by selecting a tariff, checking the order overview, making the necessary declarations and completing the payment process. Before completion, essential information such as price, term, scope of services, extension and cancellation option are displayed. For digital content, access can begin immediately after the conclusion of the contract if you expressly agree to this. To the extent required by law, you are advised that your right of withdrawal may expire prematurely if digital content begins immediately and is made available in full.

5 · Pricing, payment and paid models

The prices shown at the time of ordering apply, including VAT, if this is shown. Payment is made via the integrated payment service provider and the payment methods offered there. We do not store complete card details. Paid models can be offered monthly, annually or as a one-off digital service. Annual models are generally billed in advance. Discount campaigns, launch offers or test phases only apply under the conditions stated in each case. Free access may be functionally limited; Premium is intended to create additional depth, not artificial pressure.

6 · Term, extension and termination

Subscriptions run for the selected period and are extended by the subsequent period shown unless they are canceled in time. You can cancel current consumer subscriptions at any time using the cancel button in your profile. The termination takes effect at the end of the period already paid, unless mandatory law provides otherwise. After termination, access to premium features may be lost at the end of the period. Depending on the tariff, technical implementation and legal obligation, content that has already been created can remain viewable, exportable or deleted. Details of this must be clearly displayed in the product.

7 · Right of withdrawal

Consumers have a legal right of withdrawal. You can find details, deadlines and the sample cancellation form in our cancellation policy. In the case of digital content or digital services, the right of withdrawal can expire prematurely under the legal requirements if you expressly agree that we begin the service before the end of the withdrawal period and you confirm that you are aware of the possible loss of the right of withdrawal. This declaration must not be hidden and must be clearly displayed before purchase.

8 · User obligations and fair use

You are obliged to treat your access data confidentially and not to misuse your account. It is not permitted to automatically read Hermetia, circumvent security mechanisms, post illegal content, violate third-party rights or create profiles of other people without a suitable basis. Special care applies to relationship and resonance functions. If other people's data is entered, it must be legally and ethically responsible. Hermetia may not be used to secretly evaluate, manipulate or control other people.

9 · AI content and labeling

Parts of the content can be formulated using AI. AI-supported content is labeled in accordance with applicable transparency obligations. The calculation of profile characteristics, the convergence logic and the linguistic formulation should be treated separately. AI output can be incomplete, ambiguous, or inappropriate. They are an invitation to reflection and not an objective truth. If a piece of content doesn't suit you, you can discard it. For more information, see the AI ​​Transparency page.

10 · Rights to content and rights of use

The website, texts, graphics, structures, brands, designs, systematizations and software components of Hermetia are protected. You receive a simple, non-transferable right of use for personal use within the agreed scope of services. Content you enter, such as journal texts or reflection answers, remains your content. You only grant us the rights that are necessary to provide the selected function, to store, display, process, export or formulate content based on AI for your context of use. Personal profile content will not be passed on for advertising purposes.

11 · Availability and further development

We strive to ensure stable availability, but cannot guarantee uninterrupted availability. Maintenance, security updates, technical disruptions, changes in service providers or force majeure may temporarily restrict access. Hermetia is in active product development. Functions can be further developed, improved, renamed, supplemented or replaced, provided that the agreed core benefit of paid services is not unreasonably impaired. Significant changes are communicated transparently.

12 · Minimum age

Use generally requires a minimum age of 16 years. Paid models require a minimum age of 18 or the effective consent of legal representatives. Hermetia is not aimed at children. If future functions are planned for families, young people or particularly vulnerable groups, separate protection, consent and age concepts are required.

13 · Suspension and Termination

We can temporarily block accounts or terminate contracts for good cause if user obligations are significantly breached, payments are not made, security risks arise or the offer is used unlawfully. Before permanently blocking the matter, we take the circumstances of the individual case into account and, where possible and reasonable, provide the opportunity for clarification. Your right to ordinary termination and your legal rights remain unaffected.

14 · Liability

We have unlimited liability for intent and gross negligence as well as for injury to life, body and health. In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage that is typical for the contract. Essential contractual obligations are obligations whose fulfillment enables the proper execution of the contract and on whose compliance you can regularly rely. You take responsibility for any decisions you make based on the reflection content. Mandatory legal liability, in particular under product liability law, remains unaffected.

15 · Changes to the General Terms and Conditions

We can change these General Terms and Conditions for objective reasons, such as new functions, changes in the legal situation, technical adjustments, security requirements or new payment and tariff models. We will inform you of any significant changes within a reasonable period of time. If consent is required, we will obtain it. To the extent that an objection model is permissible, we expressly point out the deadline, the possibility of objection and the consequences of a lack of objection.

16 · Final provisions and final review

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the country in which you have your habitual residence remain unaffected. If a provision is invalid, the remainder of the contract remains effective. These Terms and Conditions are a careful launch draft. Before being released to the public, provider information, pricing logic, cancellation process, cancellation button, digital content, consumer information, data protection references and EU language versions must be legally checked.
